What data we process and why<\/h2>\n<h3>2.1 Contact form<\/h3>\n<p><strong>Data:<\/strong> name, email address and the content of the message.<\/p>\n<p><strong>Purpose:<\/strong> to handle and answer the enquiry.<\/p>\n<p><strong>Legal basis:<\/strong> the consent given by ticking the box on the form and, where the enquiry concerns a booking, the taking of steps prior to entering into a contract.<\/p>\n<p><strong>Retention:<\/strong> one year from the last communication relating to the enquiry. Messages are also stored in this website&#8217;s database.<\/p>\n<h3>2.2 Table bookings<\/h3>\n<p><strong>Data:<\/strong> name and surname, telephone, email address, number and composition of the party, date and time, allergies and intolerances disclosed, notes and booking history.<\/p>\n<p><strong>Purpose:<\/strong> to manage and confirm the booking, send reminders, tailor the service, and handle cancellations and no-shows.<\/p>\n<p><strong>Legal basis:<\/strong> performance of the booking and the steps taken prior to it.<\/p>\n<p><strong>Allergies and intolerances:<\/strong> information about allergies and intolerances is health data. It is processed solely to ensure the guest&#8217;s food safety, on the basis of the explicit consent given when providing it and, where applicable, the protection of vital interests. It is not used for any other purpose.<\/p>\n<p><strong>Processor:<\/strong> bookings are managed through the CoverManager platform, with which a data processing agreement is in place.<\/p>\n<p><strong>Booking guarantee:<\/strong> a guarantee card is required to book. Card details are processed directly by the payment service provider. The restaurant does not store the full card number.<\/p>\n<p><strong>Retention:<\/strong> for as long as the relationship with the customer lasts and, in any event, for the statutory limitation periods applicable to liabilities arising from the booking.<\/p>\n<h3>2.3 Invoicing and accounting obligations<\/h3>\n<p><strong>Data:<\/strong> name or company name, tax ID, address and transaction details.<\/p>\n<p><strong>Purpose:<\/strong> to issue invoices and comply with tax and accounting obligations.<\/p>\n<p><strong>Legal basis:<\/strong> compliance with legal obligations.<\/p>\n<p><strong>Retention:<\/strong> the periods laid down by Spanish tax and commercial law, generally four and six years respectively.<\/p>\n<h3>2.4 Marketing communications<\/h3>\n<p><strong>Data:<\/strong> name and email address.<\/p>\n<p><strong>Purpose:<\/strong> to send information about menus, openings, events and the restaurant&#8217;s offering.<\/p>\n<p><strong>Legal basis:<\/strong> the data subject&#8217;s consent, which may be withdrawn at any time, and the prior contractual relationship where the services are similar to those already contracted.<\/p>\n<p><strong>Processor:<\/strong> communications are sent using the Mailchimp platform.<\/p>\n<p><strong>Retention:<\/strong> until unsubscription is requested, which can be done from the link included in every message or by writing to restaurant@mirabona.com.<\/p>\n<h3>2.5 CCTV<\/h3>\n<p><strong>Data:<\/strong> images captured by the establishment&#8217;s video surveillance system.<\/p>\n<p><strong>Purpose:<\/strong> to ensure the safety of people, premises and property.<\/p>\n<p><strong>Legal basis:<\/strong> the controller&#8217;s legitimate interest in the security of the establishment.<\/p>\n<p><strong>Retention:<\/strong> images are deleted within a maximum of one month from capture, unless they need to be kept as evidence of acts against the integrity of people, property or premises, in which case they are made available to the competent authority.<\/p>\n<p>Areas under video surveillance are marked with the corresponding information signs.<\/p>\n<h3>2.6 Browsing this website<\/h3>\n<p><strong>Data:<\/strong> IP address, device identifiers, pages visited and usage data collected through cookies.<\/p>\n<p><strong>Purpose:<\/strong> to ensure the website works, to measure its use and, where the user allows it, to display advertising and measure its performance.<\/p>\n<p><strong>Legal basis:<\/strong> the legitimate interest in the technical operation of the site for necessary cookies, and the user&#8217;s consent for statistics, advertising and marketing cookies.<\/p>\n<p>Full details are set out in this site&#8217;s <a href=\"\/en\/cookies-policy\/\">Cookies policy<\/a>.<\/p>\n<h2>3. Recipients of the data<\/h2>\n<p>Data may be disclosed to:<\/p>\n<ul>\n<li>CoverManager, the booking management platform.<\/li>\n<li>Arsys Internet, S.L.U., the website hosting provider, with servers located in Spain.<\/li>\n<li>Google Ireland Limited, as provider of email and office software through Google Workspace, and of the Google Analytics, Google Tag Manager and Google Ads measurement and advertising services.<\/li>\n<li>Intuit Mailchimp, the platform used to send marketing communications.<\/li>\n<li>Meta Platforms Ireland Limited, through the use of the Meta pixel and embedded Facebook and Instagram content.<\/li>\n<li>The invoicing and accounting software provider, and the tax and payroll advisers.<\/li>\n<li>Banks and payment service providers, in order to collect payment for the services.<\/li>\n<li>Public authorities and official bodies, where there is a legal obligation to do so.<\/li>\n<\/ul>\n<p>Data processing agreements under Article 28 of the General Data Protection Regulation have been signed with all providers that process data on the controller&#8217;s behalf.<\/p>\n<h2>4. International transfers<\/h2>\n<p>The use of Google, Meta and Mailchimp services may involve transfers of data to the United States. These transfers are covered by the European Commission&#8217;s adequacy decision on the EU-US Data Privacy Framework and, where applicable, by standard contractual clauses and supplementary measures.<\/p>\n<p>Statistics, advertising and marketing cookies, and with them these transfers, are only activated if the user allows them in the consent banner.<\/p>\n<h2>5. Your rights<\/h2>\n<p>Any person may exercise the rights of access, rectification, erasure, objection, restriction of processing, data portability, and not to be subject to automated individual decision-making.<\/p>\n<p>To do so, send a request to <a href=\"mailto:restaurant@mirabona.com\">restaurant@mirabona.com<\/a> stating the right being exercised and enclosing a copy of a document proving your identity.<\/p>\n<p>Where processing is based on consent, that consent may be withdrawn at any time, without affecting the lawfulness of processing carried out beforehand.<\/p>\n<p>If you believe the processing does not comply with the applicable rules, you may lodge a complaint with the Spanish Data Protection Agency, C\/ Jorge Juan 6, 28001 Madrid, www.aepd.es.<\/p>\n<h2>6. Security<\/h2>\n<p>The controller applies appropriate technical and organisational measures to ensure a level of security appropriate to the risk, and requires the same of its providers.<\/p>\n<h2>7. Accuracy of the data<\/h2>\n<p>Users warrant that the data they provide is accurate and undertake to notify any changes. When providing third-party data, they declare that they have that party&#8217;s authorisation.<\/p>\n<h2>8.
